Lake Worth citizens file suit: deprived of vote on beach redevelopment
violating due process

Lake Worth FL - June 14, 2007 -

Two citizens of Lake Worth filed suit today against the City for violating their due process rights. James McCauley and Laurence McNamara, have hired the law firms of Collins & West, P.A. and
Lewis, Longman & Walker, P.A.

They assert that the City of Lake Worth deprived them of their right to vote on the beach redevelopment project as required by the referendum that was overwhelmingly approved by Lake Worth voters in 2004.

"Our problem is not with the development so much as is it is with the process", remarked McCauley, a long time Lake Worth resident. "We have a strong interest in how our City is developed, that is why the beach referendum was approved in the first place. Now the City has by-passed the requirements of that referendum by entering into this agreement with the developer and that is wrong. People need information about their right to vote and what they don't know about the beach deal with GB."

When asked about the events leading up to the suit McCauley said: "We arrived at our decision based on all the meetings we held over the past year and Laurence's letter pointing out that "twice the citizens voted to have a say, 2004 & 2005" and then a bevy of lawyers according to Lawyer Crane contrived a way to run the end of the people."

He also pointed out that during the Mayoral debates both William Coakley and John Jordan were pointing things out that needed to be answered. "We took the case to the County Commission; Greene & Marcus and to the State Attorney in April 2007 and were told that if we wanted relief to go to the civil court and we did," McCauley said.
